Whilst historically Everingham Solomons and its predecessors have delivered legal services in the New England and North West for in excess of 140 years it has strived to be the best.  However the manner in which those services are delivered has always assumed paramount importance.

TJBEveringham Solomons are pleased to announce that once again a Tamworth, Quirindi, Gunnedah or Manilla Year 12 student wishing to undertake university study in Law will have a valuable opportunity to receive the benefits of our Law Bursary.

The Sir Adrian Solomons Memorial Law Bursary provides financial assistance for the successful applicant during their first year of university as well as an opportunity to gain valuable paid work experience in our offices periodically throughout the duration of their studies.

All Principals of local High Schools have been contacted and advised of the details.  Interested students should liaise with the Principal or Careers Advisor of their school, who will assist them in making a formal application for this Bursary.

We emphasise that the selection process does not depend solely on academic merit.  We appreciate that students come from a variety of backgrounds and accordingly the selection process concentrates on the attributes of the student as a whole, rather than solely academic achievement.

The Bursary has gained widespread interest since its inception and continues to provide a valuable opportunity for current Year 12 students wishing to pursue a legal career. The Bursary is also open to students currently undertaking a gap year who will be commencing university study in 2014.

Legal Professional Privilege

MKG-newPrivilege in legal circles or legal professional privilege is a lawyer and client’s right to maintain confidences.

This means that any oral or written communication between a client and his or her solicitor cannot be disclosed.  This has the effect of allowing the client to be open and frank with his or her solicitor without fear of incriminating themselves.

This right of a client is protected by both legislation and the common law.  The Evidence Act 1995 provides that a confidential communication between a client, lawyer and/or third party is privileged, if the communication was bought into existence for the dominant purpose of providing legal advice and/or litigation.

This may sound like a fairly simple test, however you can be rest assured that lawyers will complicate it.

There have been a number of high profile matters where legal professional privilege has been raised.  Most recently Michael Williamson, the head of the Health Services Union was caught with a suitcase full of documents in a carpark following a raid on his office.  At this stage the Police have been unable to look at the documents as he has asserted that the documents were subject to a legal professional privilege claim.  This claim is yet to be tested by the courts however the documents cannot be inspected by the Police until this claim for privilege is determined.

Another high profile case is that of Rupert Murdoch in the UK.  Mr Murdoch said that his solicitors had done an investigation in which they found there was no evidence of any illegal activity.  The law firm was unable to protect itself because the advice it had given was privileged and the privilege is that of the client’s.  It could however be said that Mr Murdoch may have waived the privilege by saying what the advice was.

Advice must be legal advice and does not extend to advice given by accountants.  Having said that if the advice is to a solicitor (about a mutual client), then it would be covered by legal professional privilege.

Sir Adrian Solomons Memorial Law Bursary – Awarded

TJBWe are pleased to announce that the 2011 bursary recipient is local student Nathan Whale. Nathan completed Year 12 at Farrer Memorial Agricultural High School in 2010 and then undertook a gap year. This is the third time a student from Farrer has been awarded the Bursary.

Nathan has enrolled in a Bachelor of Business Information Systems – Bachelor of Laws Degree at the University of Wollongong. We are very confident that he will prove to be an outstanding student and, ultimately, an exceptional asset to the legal community.

The continued interest shown in the Sir Adrian Solomons Memorial Bursary by Higher School Certificate students from our local schools has been extensive and the quality of the applicants every year has made the selection process very difficult indeed.

This firm has, over the last 14 years, offered an annual bursary for local high school students completing their Higher School Certificate and securing admission to a tertiary facility to pursue a career in Law.

To encourage our youth in this way has been most rewarding for this firm. We  continue to be astounded by the quality of applicants, their range of interests and their enthusiasm and motivation to achieve. Such qualities in these young people reflects well on our local High Schools.

Students currently contemplating a career in Law who are sitting for the Higher School Certificate this year are encouraged to make an application for the Bursary by submitting their curriculum vitae to this firm prior to 30 November 2012. We will contact the Schools later in the year to arrange for this opportunity to be raised with interested students.

Women in Business Charity Movie Night

RHGI have my dress chosen, the high heels co-ordinated; I am wondering whether elbow-length gloves and some pearls would be the final additions to my outfit? I am getting frocked-up for the Women in Business Charity Movie Night co-hosted by Eversols and the National Australia Bank.

With the assistance of Forum 6 Cinema, we have secured a private screening of the classic “High Society”, starring the glamorous Grace Kelly, in support of Ovarian Cancer.

As the event will support Frocktober, we are asking attendees to wear a dress to the movie. For those more daring, 1950s Hollywood glamour will be the theme of the night.

So channeling the enchanting Princess of Monaco, I have selected my dress and I am gathering all my loose change together for the raffles and auction items that will feature at intermission.

I am most looking forward to the auction of several blokes who will kindly donate their time & handy-man skills to the highest bidder. Andrew Warden, winner of this year’s Young Auctioneer competition at the Sydney Royal Easter Show and stock & station agent with Ray White Garvin & Cousens, will convene our auction and talk up the fellas (as if they don’t do it enough themselves!) who will be available for “purchase”. We are hoping that the highest bidder will utilise the team of blokes for a business renovation or better still, donate the boys to a charity who could use some hands-on assistance. Hopefully the ladies who attend the night will be in need of some muscle and will be willing to bid up the boys in aid of a great cause.

As the event will be in support of Frocktober, we are inviting female professionals to leave behind their boring suits and office attire and to glam up old Hollywood style for a special screening of “High Society” starring Grace Kelly.

Ladies this is your opportunity to put on a dress and if you are more daring to channel the glamour of a foregone era in a 1950s Hollywood inspired dress, and come along and participate in a quality networking event with fellow business women and professionals.

The movie intermission will feature an auction of various exciting items including an auction of male working bees who will visit the successful bidders home to attend to a hive of outside chores all in a bid to raise funds for Ovarian Cancer Research.

The aim of the evening is twofold. Firstly, the event will provide a forum for female professionals to meet, network and enjoy what promises to be a very entertaining evening. Secondly the event is in support of Frocktober which seeks to raise funds for Ovarian Cancer Research and for good reason, with an average of 3 women being diagnosed with Ovarian Cancer each day.

New Associate

TJBThe Directors are delighted to announce the appointment of Jessica Simmonds as Associate to the firm.

Jessica joined Everingham Solomons some 9 years ago initially as a Law Clerk whilst studying for her Law Degree.

Jessica has developed over the years an expertise in Wills and Estates including Family Provision Act claims in addition to pursuing her strong interest in Employment Law.

Jessica has been a regular speaker at various interest groups to assist people navigating the complex legislation surrounding the respective rights and obligations cast upon both employers and workers.

Jessica during her time at Everingham Solomons has made a substantial contribution that has now been most appropriately recognised in elevating her to the position of Associate with this firm.
